These Terms of Service (“Terms”) govern your access to and use of the services provided by researchmena (“researchmena”, “we”, “us”, or “our”), including our website located at researchmena.com and any related software, applications, and services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

1. Eligibility and Use

The Services are intended for use in a business or professional context. By using the Services, you represent that you are at least 18 years old and that you are using the Services for lawful business, professional, or research-related purposes.

You may use the Services only in compliance with these Terms and all applicable laws and regulations.

2. Description of the Services

researchmena provides a platform intended to help companies, product teams, researchers, and other organizations recruit participants, manage research operations, and conduct user research and related activities.

The Services may include tools and support for participant sourcing, research coordination, participant communication, scheduling, incentive handling, payment workflows, and related operational support.

researchmena does not guarantee the suitability, availability, responsiveness, or outcomes of any participant, study, or research activity conducted through the Services.

3. Accounts and Access

To access certain features of the Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, complete, and current information and to keep your account information updated. You must promptly notify us of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Services for any unlawful, harmful, deceptive, or fraudulent purpose

  • Misrepresent your identity, organization, or research purpose

  • Interfere with or disrupt the integrity, security, or performance of the Services

  • Attempt to gain unauthorized access to the Services or related systems

  • Use automated means to access the Services in a manner that exceeds reasonable usage or violates these Terms

  • Reverse engineer, decompile, or attempt to extract source code from the Services, except to the extent permitted by law

  • Use the Services to collect, store, or process sensitive personal information unless you have all required rights, notices, and consents under applicable law

  • Contact participants outside the intended scope of a study, or in a way that violates applicable privacy, consumer protection, or marketing laws

  • Use participant data for unrelated sales, spam, or unauthorized marketing purposes

We reserve the right to suspend or terminate access for violations of these Terms.

5. Customer Data and Research Data

Your use of the Services may involve the processing of data submitted by you or your authorized users, including research materials, participant criteria, study information, communications, payment-related instructions, and other content (“Customer Data”).

You retain all rights, title, and interest in Customer Data.

You represent and warrant that you have all necessary rights, permissions, and consents to provide Customer Data to researchmena for processing in connection with the Services.

If you collect or process participant personal data through the Services, you are solely responsible for ensuring that such collection and processing complies with all applicable privacy, consumer protection, research, and marketing laws and regulations.

Our collection and use of personal data is described in our Privacy Policy.

6. Participant Recruitment, Incentives, and Payments

If the Services involve participant recruitment, coordination, or incentive distribution, you are responsible for:

  • Providing accurate study descriptions and eligibility requirements

  • Using participant information only for legitimate research purposes

  • Complying with all applicable consent, privacy, outreach, incentive, tax, and payment requirements

  • Ensuring that the incentive amounts, qualification rules, and payment conditions for each study are accurate and lawful

  • Not using participant data for unrelated sales, spam, or unauthorized marketing purposes

researchmena may facilitate or handle participant incentive payments or other related payment workflows on your behalf. However, you remain solely responsible for the underlying study terms, eligibility decisions, payment approval conditions, legal compliance, and any obligations owed to participants.

researchmena is not responsible for disputes between you and participants regarding eligibility, completion status, incentives, payments, reimbursements, or research outcomes, except to the extent caused directly by our failure to perform the payment workflow as described.

7. Fees and Payment

Certain features of the Services may be subject to fees. Pricing, billing terms, service charges, and payment requirements will be communicated to you separately and may change from time to time.

Unless otherwise stated, fees paid to researchmena are non-refundable except as required by law.

You are responsible for providing complete and accurate billing and payment information and for timely payment of all applicable fees.

If researchmena handles participant incentives, reimbursements, or related payouts on your behalf, you authorize us to process such payments in accordance with your instructions and the applicable study terms. You are responsible for ensuring that sufficient funds are available and that all payment details and recipient information are accurate.

researchmena may suspend Services or withhold payment processing where payment information is incomplete, funds are unavailable, fraud is suspected, or legal or compliance concerns arise.

8. Intellectual Property

The Services, including all software, workflows, branding, content, documentation, and related materials, are owned by researchmena or its licensors and are protected by intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services solely for your internal business or research purposes.

You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Services except as expressly permitted by these Terms.

9. Third-Party Services and Integrations

The Services may integrate with or link to third-party services, tools, payment providers, or platforms. researchmena does not control and is not responsible for the content, availability, security, or practices of third-party services.

Your use of third-party services is governed by their respective terms and policies, and you are solely responsible for complying with them.

10. Email Communications

By providing your email address and opting in to receive communications from researchmena, you consent to receive emails related to your account, studies, scheduling, platform updates, research opportunities, payment notifications, and, where permitted, promotional communications.

You may unsubscribe from marketing emails at any time using the unsubscribe link in any marketing email we send. You may still receive transactional or service-related emails where necessary for account administration, research coordination, or payment handling.

You are responsible for notifying us of any changes to your email address.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESEARCHMENA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

RESEARCHMENA DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR THAT ANY PARTICIPANT, MATCH, RESPONSE, PAYMENT WORKFLOW, OR RESEARCH OUTCOME WILL MEET YOUR EXPECTATIONS OR REQUIREMENTS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESEARCHMENA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, OR LOST RESEARCH OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESEARCHMENA’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO RESEARCHMENA FOR THE SERVICES IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless researchmena, its affiliates, and their respective officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Services

  • Your Customer Data

  • Your research studies, participant outreach, communications, incentives, or payments

  • Your violation of these Terms or applicable laws or regulations

  • Your infringement or misappropriation of any third-party rights

  • Any dispute between you and a participant relating to eligibility, participation, incentives, or payments

14. Suspension and Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms, create risk or legal exposure for us, fail to pay applicable fees, or if we discontinue the Services.

Upon termination, your right to use the Services will immediately cease. Sections that by their nature should survive termination will remain in effect, including provisions relating to intellectual property, disclaimers, limitation of liability, indemnification, governing law, and payment obligations.

15. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Arab Republic of Egypt, without regard to conflict of law principles.

You agree to submit to the exclusive jurisdiction of the competent courts of Cairo, Egypt for any disputes arising out of or relating to these Terms or the Services.

16. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website with a revised “Last Updated” date. Your continued use of the Services after the updated Terms become effective constitutes acceptance of the revised Terms.
